Terms of service

Effective 26 September 2026.

These terms govern your use of ShiftMyData. Using the service means agreeing to them. If you are accepting on behalf of an organisation, you are confirming you may bind it.

The agreement is between you and Naresh Kumar D, a sole proprietorship , based in India. "We" and "us" below mean that party.

The service

ShiftMyData transfers, copies, synchronises and backs up files between cloud storage services on your instruction. Transfers run on our servers, so they continue when your computer is off. We do not provide storage ourselves — every file lives in a service you already have an account with.

Your account

You need an account, you must give an address you control, and you are responsible for what happens under it, including keeping your password safe. Two-factor authentication is available and recommended. Tell us promptly if you believe your account has been used without your permission.

Sub-accounts may be given access to specific folders. Whoever creates a delegation remains responsible for what the delegate does with it, and the delegate's transfers count against the owner's allowance.

The cloud accounts you connect

By connecting a service you authorise ShiftMyData to access it on your behalf for the operations you request. You confirm you are entitled to grant that access and that doing so does not breach your agreement with that provider. You may disconnect at any time, and you can revoke access from the provider's own security settings.

Those providers are independent of us. Their availability, their rate limits, their pricing and their decisions about your account are theirs, not ours, and we are not responsible for them.

Acceptable use

You agree not to use ShiftMyData to:

• transfer material you have no right to copy, including infringing content;
• transfer unlawful material, or material you are prohibited from possessing;
• distribute malware, or attack, probe or overload any system;
• evade a provider's limits or terms, or resell the service as your own without agreement;
• interfere with the service's operation or other users' use of it.

Accounts used this way may be suspended without notice.

Allowances and payment

Bandwidth is what this service costs to run, so transfer volume is measured per calendar month against an allowance shown in the application. Paid top-ups and redeemed codes increase it.

• Prices are shown before you pay, in the currency stated, inclusive of taxes where they apply.
• Payment is taken by our payment provider. We never receive your card details.
• Allowance is consumed as bytes move. Because bandwidth already spent cannot be returned, purchased allowance is non-refundable once used; unused allowance may be refunded at our discretion within a reasonable period.
• Where a subscription renews automatically, you will be told before each charge and may cancel at any time, effective at the end of the paid period.
• Reaching your allowance prevents new transfers from starting. A transfer already running is allowed to finish.

Availability

We work to keep the service running but do not guarantee it will be uninterrupted or error-free. Maintenance, provider outages, rate limits and network faults all cause interruptions. The service is provided "as is", without warranties of any kind so far as the law allows.

Liability

Keep your own backups. A transfer moves or deletes real files, and a mirroring sync deletes at the destination by design. Check what a job will do before running it.

So far as the law allows, we are not liable for lost profits, lost data, or indirect or consequential loss, and our total liability for any claim is limited to what you paid us in the twelve months before it arose. Nothing here excludes liability that cannot lawfully be excluded.

Suspension and termination

You may stop using the service at any time, and delete your account yourself from Account settings in the application, or on request to the contact address. We may suspend or close an account that breaches these terms, that is used unlawfully, or where required by law. On closure your stored credentials and data are deleted as described in the privacy policy.

Changes

These terms may change. Material changes will be announced in the application before taking effect, and the effective date above will change with them.

Governing law

These terms are governed by the laws of India, and the courts of Chennai, Tamil Nadu have exclusive jurisdiction over any dispute.
